In this case the image is located inside the Monastery of Sancti Spiritus of Toro, in Zamora (Spain) in [http://elmuseomonasteriosanctispiritus-toro.blogspot.com.es/2012/07/escrito-sobre-la-silleria-del-coro.html this room] (at the end of the room), which is not either a park, street, square or public thoroughfare. : FOP is not an issue if the sculptor died before 1933. I don't know how old the statue is, though, and in any case, since the photo comes from a book, we either need evidence that the photographer died before 1933 or that the photographer has licensed the photo under a free licence.
