This would seem to make Germany a special exception to standard EU law on copyright, unless "anonymous" is different to "unknown". I think I'm missing something in the rationale here, and as I have personally uploaded quite a few thousand WWII period photographs, could you point to the right bit of Commons policy or guidelines?
