*:::::The only thing copyrightable about satellite imagery is the choice of lighting, presentation, etc., which combine as a whole to make it copyrightable. It is possible to create a derivative work of a copyrightable work which is not subject to the copyright of the original work. For an extreme example, if you took [[w:File:Sgt. Pepper's Lonely Hearts Club Band.jpg]] and created an image whose color is the average of the entire image throughout, then of course it does not meet the threshold of originality. Here we have a more subtle case, but the key is that we are working with facts: the places are where they are, and you can't change that. This is the crux of the argument in ''[[w:Feist v. Rural|Feist v. Rural]]''. A phone book is copyrightable due to its layout, specific choice of arrangement, etc., but if you just copied the entries from it (which are facts), that would not be a copyright violation.
